There have been a lot of discussions about the solar PV Feed-in Tariff recently. The government’s appeal to drop the Feed-in Tariff rate from 43.3p/kWh to 21p/kWh by December 12th 2011 rather than in April 2012 has stirred a lot of insecurities with people who were considering the installation of a PV system to profit from the Feed-in Tariff.
However, recent events have seen the appeal to drop the FIT early judged “unlawful” by the High Court earlier this month. This decision was upheld by the Court of Appeal on Wednesday, January 25th 2012. The government has suggested a back-up plan in which the new cut-off date for the high Feed-in Tariff rate should be March 3rd, however, they will appeal to Court again.
Regardless of what the decision of the new appeal will be, it will NOT have any influence on installations for which the Feed-in Tariff application has been received by the FIT provider before December 12th 2011.
If the appeal is successful this time it would mean that any installation eligible for the FIT between December 12th 2011 and March 2nd 2012 will get the higher rate of 43.3p/kWh until April 1st 2012 and from then on the lower rate of 21p as proposed in the consultation.
If the appeal does not succeed, the new Feed-in tariff rate will be paid on any installation the FIT application for which has been received by the FIT provider by the cut-off date of March 2nd 2012. Installations thereafter will be getting the lower rate of 21p/kWh and installations after April 1st 2012 will still be able to profit from the rate of 21p/kWh, however, they may have to comply with additional energy efficiency requirements.
